THIS APPRAISAL REPORT IS INTENDED FOR USE AS A FIRST TRUST DEED ONLY IN THIS MORTGAGE FINANCE TRANSACTION ONLY. THIS APPRAISAL REPORT IS NOT INTENDED FOR ANY OTHER USE. THE BORROWER IS NOT THE INTENDED LENDER/CLIENT OR THE INTENDED USER. THE INTENDED USER OF THIS APPRAISAL REPORT IS AND IS GIVEN A ONE TIME LICENSE AS A ONE TIME USER OF THIS APPRAISAL REPORT ONLY. THERE ARE NO OTHER INTENDED USERS. ANY OTHER PARTY IS AN UNINTENDED USER AND MAY NOT RELY ON THIS APPRAISAL REPORT. THE APPRAISER IS NOT LIABLE FOR ANY OTHER THIRD PARTY CLAIM. ANY CLAIM IS LIMITED TO THE APPRAISAL REPORT FEE. USE OF THIS APPRAISAL REPORT AND OR POSSESSION CONSTITUTES ACCEPTANCE OF THESE CONDITIONS.
Appraisal invoices are to be paid upon receipt of invoice. If we do not receive payment within 30 day of the date of this invoice, we shall add a late payment charge of $25 calculated monthly beginning on the 31 day of the date of this invoice of your total unpaid balance. The late payment is a penalty and does not relieve you of the obligation to pay the total amount due by the due date. In the event any action is required to enforce the terms of this agreement, the prevailing party shall be entitled to responsible attorneys fees, loss incurred and the venue to be in the State of California, County of San Diego. According to California Civil Code 2334: A principal is bound by acts of their agent, under a merely ostensible authority, to those persons only who have in good faith, and without want of ordinary care, incurred a liability or parted with value, upon the faith thereof.
